Terms and Conditions of Sale
These Terms and Conditions govern the sale of products to you by ThreeTy Ltd (“we”, “us”, “our”). By purchasing from our website, you agree to be bound by these Terms together with our Shipping & Delivery Policy, Returns & Refund Policy, and Privacy Policy.

1. Introduction
- The advertising of products on our website constitutes an invitation to treat rather than a binding offer.
- You will be asked to expressly agree to these Terms before placing an order.
- Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or the Consumer Contracts Regulations 2013.
2. Interpretation

3. Order Process
- To place an order, add items to your cart and proceed to checkout.
- You must enter accurate billing, delivery and contact information.
- Payment is taken at checkout via our authorised payment provider (Shopify Payments or other providers shown at checkout).
- You will receive an order acknowledgment email. A contract is formed only when we send an order confirmation email.
- If we cannot fulfil your order, we will notify you and issue a refund where applicable.
- You may correct errors before completing the checkout process.
4. Products
- Our products include specialist pillows and pillowcases.
- We may update or discontinue products without prior notice.
- All images are illustrative; colours may appear differently depending on your device.
5. Prices
- Prices are shown inclusive of VAT where applicable.
- We may update prices at any time, but changes do not affect orders already confirmed.
- Delivery charges, where applicable, are displayed at checkout.
- If a pricing error occurs, we are not obligated to supply the item at the incorrect price.
6. Payments & Chargebacks
- You must pay for goods at checkout using one of the accepted payment methods.
- We may cancel orders where payment fails or is reversed.
- An unjustified chargeback will make you liable for:
- the chargeback amount;
- bank/payment processor fees;
- a £25 administration fee;
- reasonable recovery costs including legal fees.
7. Delivery
- Delivery times are estimates only; delays may occur due to courier or customs issues.
- We will deliver to the address provided at checkout. Customers are responsible for ensuring the address is complete, correct, and deliverable.
- Failure to provide accurate address information may result in:
- delays,
- return-to-sender fees,
- non-delivery, or
- loss of goods.
- We are not responsible where delivery fails due to refusal, absence, or lack of access.
- If delivery cannot be completed and the parcel is returned to us, Section 15 (Unclaimed / Undeliverable / Refused Parcels) applies.
8. Cancellation Rights (Consumer Contracts Regulations)
- If you are a consumer, you may cancel your order within 14 days of receiving your goods.
- You must notify us of your intention to cancel within the 14-day cooling-off period.
- Items must be returned in original, unused, undamaged condition and in original packaging.
- You must return goods within 14 days of cancellation.
- You are responsible for return shipping costs unless otherwise stated in our Returns Policy.
- We may deduct amounts reflecting loss in value due to handling beyond what is necessary to establish the nature and characteristics of the goods.
9. Warranties & Representations
- You warrant:
- you are legally capable of entering into contracts;
- information supplied during checkout is accurate;
- you will accept delivery at the address provided.
- We warrant:
- we have legal title to the goods;
- goods match their description;
- goods are of satisfactory quality.
10. Limitations of Liability
- Nothing limits liability for death or personal injury caused by negligence or fraud.
- We are not liable for:
- business losses;
- loss of profits, revenue, data, goodwill;
- losses caused by courier delays or customs delays;
- losses resulting from incorrect addresses or failure to collect parcels;
- events beyond our reasonable control.
11. Order Cancellation by Us
- We may cancel orders where payment fails, goods are unavailable, or fraud is suspected.
- We may cancel where external events prevent fulfilment.
12. Consequences of Cancellation
- On cancellation, undelivered goods will not be dispatched.
- You must pay for goods already delivered.
13. Restocking Fees & Deductions
- Pillowcases & small accessories: 10% of item value
- Pillows & large items: 15% of item value
- Return shipping fees, including courier return charges, may be deducted from refunds.
14. Duties, Taxes & Import Fees
Duties, taxes and customs charges are non-refundable, as they are not collected by ThreeTy Ltd.
15. Unclaimed, Refused or Undeliverable Parcels
- If a parcel is refused, not collected, or undeliverable due to incorrect address or failure to facilitate delivery, it may be returned to us by the carrier.
- We will hold returned parcels for 30 days awaiting your instruction.
- If you request a refund, deductions will apply:
- original shipping cost (including “free shipping” promotions),
- carrier return fees,
- restocking fees (as above).
- If no contact is made within 30 days, the parcel is considered abandoned and no refund will be issued.
- If carrier return fees exceed the value of the goods, no refund will be provided.
16. Customer Responsibilities
- Provide a correct, complete delivery address.
- Monitor tracking updates.
- Respond to courier or customs notifications.
- Collect parcels in a timely manner.
17. Variation
We may update these Terms at any time. Changes apply to orders placed after the date of update.
18. Assignment
- We may transfer our rights and obligations under these Terms.
- You may not assign your rights without our consent.
19. No Waiver
Failure to enforce any provision does not constitute a waiver of our rights.
20. Severability
If any provision is deemed invalid, the remaining provisions remain in full force.
21. Entire Agreement
These Terms, together with our policies, constitute the entire agreement between you and ThreeTy Ltd regarding product sales.
22. Governing Law & Jurisdiction
These Terms are governed by English law. Disputes are subject to the exclusive jurisdiction of the courts of England & Wales.
